General terms and conditions of sale

Preamble

The present conditions are concluded exclusively between the company CORNILLEAU SAS, a simplified joint-stock company with a capital of 1,153,800 euros, whose registered office is located at La Folie – 14 route Nationale – 60120 Bonneuil les Eaux, registered with the Beauvais Trade and Companies Register under number 526 920 194, hereinafter referred to as "CORNILLEAU" or "the Company", and any natural person, non-professional, of legal age, capable of visiting or making a purchase via the website fr.cornilleau.com, hereinafter referred to as "the Internet User" or "the Client."

The parties agree that their relations will be governed exclusively by these general terms and conditions of sale, which are accessible on the website fr.cornilleau.com.

These conditions may be subject to modifications. It is therefore understood that the applicable conditions are those in force on the website at the time the contract is concluded.

Finally, these general terms and conditions of sale define the terms of sale between CORNILLEAU and the Internet User. They regulate the various steps to be followed to place an order on this website. The date of publication of these General Terms and Conditions of Sale shall be deemed to be the date of entry into force.

The present General Terms and Conditions of Sale, as well as the preamble which forms an integral part thereof, apply to all sales of products and services provided by our Company. Consequently, placing an order by the Client implies his/her unconditional adherence to these terms and conditions, which prevail over any other document emanating from the Client, and in particular over any general terms and conditions of purchase.

ARTICLE 1 – CONTRACT

The Internet User declares to be 18 years old and to have the legal capacity to contract on our website fr.cornilleau.com as well as to respect these general terms and conditions of sale, or to have parental authorization allowing them to place an order on the website fr.cornilleau.com.

The ordering process by the Internet User takes place in several stages as defined below:

- The Internet User fills out the identification form, providing all the requested information or giving their Customer number if they have one,

- The Internet User fills out their online order form by providing all the references of the chosen products or services,

- The Internet User chooses their delivery method,

- The Internet User chooses their payment method,

- The Internet User validates their order after verifying it,

- The Internet User submits their payment request and makes the payment,

- The Internet User then receives an email from CORNILLEAU confirming their order and payment, as well as the corresponding invoice.

The order confirmation email signifies CORNILLEAU's acceptance of the Internet User's order and thus forms the sales contract between the parties.


The online provision of the credit card number and the final validation of the order by the Internet User constitute proof of the entirety of the order. This validation serves as a signature and acceptance of all operations carried out on the website by the Internet User.


In the case of an order exceeding €150, as well as in the context of anti-fraud checks aimed at securing its customers' transactions, CORNILLEAU reserves the right to ask the Internet User to provide one or more proof of address and/or a copy of an identity card by email or fax before validating their order. The order will only be final upon receipt by CORNILLEAU of these documents and the sending of the confirmation email. In the absence of receipt of these documents or if they do not allow the identification of the author of the order and the reality of their residence to be determined with certainty, CORNILLEAU reserves the right not to accept the order.


CORNILLEAU also reserves the right to check and/or refuse an order if there is an ongoing dispute or an abnormally high level of orders with the Internet User.

Unless proven otherwise, the computer records and those of CORNILLEAU's service providers, kept under reasonable security conditions, will constitute proof of all transactions between CORNILLEAU and the Internet User.


The Company also archives the order forms and invoices on a reliable medium. In accordance with legislative provisions, the Internet User may access them by requesting them by mail from CORNILLEAU and by attaching their order form and invoice.


CORNILLEAU recommends that the Internet User keep the confirmation email of their order and payment. CORNILLEAU will also subsequently send them an email confirming the shipment of their order.

ARTICLE 2 - PRODUCTS

CORNILLEAU strives to describe and present the items sold on the website with the greatest accuracy. However, certain characteristics of the products may be slightly modified, notably to improve their quality or safety. If, despite this, errors have occurred, CORNILLEAU cannot be held responsible for this.

Similarly, the product photos displayed on fr.cornilleau.com remain non-binding. Under no circumstances can CORNILLEAU be held liable based on these photos.

Regarding packaging in particular, all our tables are packaged in two different ways:

- individually: each table is packaged unassembled in a reinforced individual cardboard box.

- assembled individually: each table is assembled and packaged on an individual pallet.

Our spare parts and accessories are packaged in such a way that their protection is fully ensured during transport.

ARTICLE 3 - PRICING

All prices displayed on the website are in euros excluding shipping costs and all applicable charges in mainland France. VAT is applied at the rate in effect at the time of ordering. Any change in the rate would be applied immediately to the current order.

The prices of the products are excluding shipping costs, the price of certain packaging, or the price of other optional services, subscribed to by the Internet User, which remain additional. These will be brought to the attention of the Internet User on the summary screen before final validation of the order.

The amount of shipping costs is mentioned at the time of order validation by the Internet User, which includes:

- administrative processing of the order,

- preparation and shipment of the package(s),

- transportation costs.

ARTICLE 4 – AVAILABILITY

Our product offers and prices are valid as long as they are visible on the website. The Internet User is therefore invited to check the availability of the items sold on the information page of each product.

Consequently, CORNILLEAU does not guarantee the maintenance of products for sale for a given period. Any claim by the Internet User regarding the order or delivery of an unavailable item will be considered unfounded and cannot in any way engage the responsibility of CORNILLEAU.

In the event of a validated order for which a product or item has become unavailable within the time frame announced on the website, the entire order will only be processed and shipped when all the products of that order are available. CORNILLEAU will then inform the Internet User of this additional delay. However, the Internet User may choose to receive the available items of their order first;

However, if it turns out that this product is permanently unavailable, CORNILLEAU will inform the Internet User of this unavailability. The Internet User must then choose between:

- canceling the entire order: CORNILLEAU must cancel the entire order and undertake to credit the Internet User's account associated with the provided credit card number.

- or receiving the ordered available products: The Internet User will then be liable only for the amount of the shipped products as well as the shipping costs associated with the shipment of these products and the amount of the services they have chosen. CORNILLEAU must partially cancel the order and undertake to credit the Internet User's account associated with the provided credit card number.

In either case, in the event of a blockage or any impossibility to credit the Client's account, a check will be sent to them by CORNILLEAU's customer service.

ARTICLE 5 – DELIVERY

in France

Products can be delivered anywhere in mainland France and Corsica, except for delivery to a freight forwarder. They will be delivered to the delivery address provided by the Internet User when placing the order.

For parcel tracking purposes, CORNILLEAU reserves the right to refuse delivery of orders from individuals to collective addresses such as barracks, military premises, hospitals, holiday clubs, etc., this list being non-exhaustive.

The delivery times announced on the website apply from the Internet User's receipt of the shipping confirmation email sent by CORNILLEAU. In accordance with the provisions of Article L216-1 of the Consumer Code, the delivery date indicated when placing the order constitutes the deadline by which the Company undertakes to deliver the products to the Client, with the clarification that carriers do not deliver on Saturdays, Sundays, or public holidays. Unloading, installation, assembly, and delivery to upper floors are not included in the carrier's service. Additional shipping charges may be applied for delivery to islands, mountain resorts, and generally to locations that are difficult to access by truck.

In the event of exceeding the expected delivery time, the Client is entitled, in accordance with Article L216-2 of the Consumer Code, to send the Company a formal notice by registered letter with acknowledgment of receipt, urging it to deliver the ordered products within a reasonable additional period. If the Company still fails to comply, the contract may be terminated automatically by the Client by means of a new letter addressed to the Company notifying it of this decision, upon receipt of said letter. The amounts paid by the Client will then be refunded no later than fourteen days following the date of termination of the contract, excluding any compensation or withholding.

The transfer of risks of loss and damage occurs upon delivery to the Client. In the event of unjustified refusal of delivery, in whole or in part, of the ordered goods, CORNILLEAU reserves the right to invoice the transportation and incurred expenses.

In the event of anomalies occurring during transport (damaged packaging, shortages, or damage), it is the responsibility of the recipient to:

- make all necessary reservations upon delivery on the delivery receipt;

- confirm them to the carrier by registered letter with acknowledgment of receipt within three days following the receipt of said goods;

- report them to CORNILLEAU within the same period, in accordance with the provisions of Article 8.

The absence of reservations signed upon receipt of the goods by the Client extinguishes any claim.

The procedure as well as the contact details of CORNILLEAU are indicated on the website. Failure to comply with the reservation or complaint procedure will prevent the Client from lodging any claim with CORNILLEAU.

in the European Union

Tables are shipped from France and typically arrive within 7 to 14 working days (Monday to Friday). All deliveries are scheduled in advance. 

Please note that the crates weigh over 100kg and requires assistance to handle and transport the item or its parts to your home. 

Geographical exclusion: We are unable to carry out deliveries to the outermost regions of the EU. Açores, Madeira, Canarias and French DROM. Please contact us for specific deliveries to these regions which might incur extra cost. For remote and mountain resorts and locations that are difficult to access by truck specific restrictions might also apply.

ARTICLE 6 – PAYMENT

The Internet User can pay for their purchases by Credit Card with a Carte Bleue, Visa, or Mastercard.

The Internet User's bank account will be debited for the amount of the products and services chosen by them, within 48 hours following the payment, subject to the value dates applied by banking institutions. CORNILLEAU guarantees the security of payment by credit card by using the MERCANET encryption system and by enlisting the services of BNP PARIBAS for payment processing.

In the event of opposition to payment or any refusal by the Bank to honor the payment, the order placed by the Internet User will be automatically canceled, and the Internet User will be notified by email.

Payment for your order in 3 or 4 installments by CB from €150 of purchases up to €6000 with Oney Bank.

ARTICLE 7 - RIGHT OF WITHDRAWAL

In accordance with current legal provisions, The Client, if they are a non-professional individual, has a withdrawal period of fourteen (14) days from the delivery of their order to return the product to CORNILLEAU for exchange or refund without penalty, except for return costs.

If the Internet User wishes to exercise their right of withdrawal, they simply need to assert this right by completing the following form: WITHDRAWAL FORM. CORNILLEAU will then provide them with the procedure to follow to make their return.

The Client wishing to exercise their right of withdrawal must return the products, under the conditions defined in Article 8 below, no later than 14 days following the date of sending their withdrawal notification to the Company's address.

CORNILLEAU will refund the Internet User by any means of the price of the product and the initial shipping costs within a maximum period of 8 days from the receipt of the package, provided that the product is returned complete, in perfect condition, and in its original packaging.

In the event of a partial return of the order, CORNILLEAU will refund the Client the amount of the shipping costs proportional to the total amount of the order.

In the event of a total return of the order, CORNILLEAU will refund the Client the total amount of the shipping costs paid when placing the order.

All return shipping costs of the product to CORNILLEAU, as well as all costs and risks associated with this return, remain the responsibility of the Client.

If, however, a problem arises regarding the retrieval by the Client of the delivered order, especially an issue with the delivery address provided by the Client resulting in a return to CORNILLEAU, CORNILLEAU will then contact them to validate the return of the order. In that case:

- in the absence of a response from the Client within 15 days following this reminder, CORNILLEAU will consider that they have exercised their right of withdrawal on this order;

- in the event of a positive response for the return within this fifteen-day period, CORNILLEAU reserves the right to charge the Client for the shipping costs of this new shipment.

ARTICLE 8 – RETURNS

Except for the withdrawal right mentioned in article 7, the Internet User may need to return their product for the following reasons only: unsatisfactory item because it does not conform to the order, missing item, defective, or damaged item during transport.

The Internet User must check the condition of the package and the products inside the package upon delivery and must make all necessary reservations on the delivery note, according to the procedure described in Article 5. Otherwise, no claim can be made by the Internet User to CORNILLEAU.

The Internet User has three days upon receipt of the package to inform CORNILLEAU of their claim by logging into their order via the contact area of the website. CORNILLEAU will then provide them with the procedure to follow to make their return.

The Internet User must also include with their return package a copy of the documents relating to the defective delivery (delivery note, reservations, order number) to allow the processing of their claim.

The Internet User is invited to contact CORNILLEAU's Customer Service within the same three-day period. Customer Service may then, if necessary:

- cover the necessary costs for the return of the product.

- assist the Internet User in exchanging the Product or placing a new order for a conforming product and arrange for its shipment at their expense, subject to availability of the requested product in stock.

If the ordered Product is no longer available at the time of return, CORNILLEAU will then refund the missing Product and the outbound shipping costs proportionally to the overall order.

If the return is not validated by CORNILLEAU, especially if the reservations have not been stipulated on the delivery note and if a copy of it has not been attached to the return, then this return will be considered as non-compliant and treated as such.

The Client is responsible for the packaging of their product, which must be done in such a way that the product can travel without the risk of breakage or damage. In general, all risks related to the return of the product are borne by the sender. Indeed, the Client remains free to choose their mode of sending the return order and whether or not to take out any insurance, particularly in case of theft, loss, or destruction of the package. Under no circumstances can CORNILLEAU be held responsible for the non-receipt of the package sent by the Client.

Only products returned complete, in perfect condition, and in their original packaging will be accepted. Otherwise, the return will be considered as non-compliant and treated as defined in Article 10 of these General Terms and Conditions of Sale.

ARTICLE 9 – WARRANTIES

9.1 – COMMERCIAL WARRANTY

a) Conditions

Any warranties related to the products sold are clearly detailed on their descriptive sheet or in their instructions.
However, these warranties do not affect the legal warranty for hidden defects or the legal warranty of conformity as defined below.

PING PONG TABLES

For indoor table tennis tables and accessories, the warranty period is 3 YEARS from the date of purchase by the end consumer. For outdoor tables, the warranty period is extended to 10 YEARS, excluding wear parts (posts, nets, and wheels), excluding alterations in shades, and within the framework of the EN 14468 standard.

For tables branded TECTONIC or Private Label, the warranty is for 2 years and 3 years for outdoor tabletops.

The warranty is limited to providing the parts recognized as defective by our services and does not apply to damage caused by:

For indoor tables and outdoor tables: normal wear and tear of parts, improper assembly not following the instructions provided with each table, failure to follow the usage and safety instructions located under the tabletop and in the instructions, lack of maintenance, use of aggressive cleaning products, wind causing tables to fall in the storage position, practicing alone or overturning during play, or generally any cause unrelated to the quality of the tables (impact, falls).

For indoor tables: abrasive plastic balls, prolonged exposure to sunlight, excessive humidity, and rain. Not included in the warranty: shipping costs for defective parts, technician's travel, labor costs, cash or in-kind compensation for table immobilization during the warranty period.

For added child safety, we strongly recommend using our protective covers.

Any claim must specify the type of table, the serial number located under the tabletop, the incriminated part(s), and be accompanied by any proof and the date of purchase.

OUTDOOR BILLIARDS

For outdoor billiards, the warranty period is 5 YEARS from the date of purchase by the end consumer. For billiard accessories, the warranty period is 3 YEARS.

The warranty is limited to providing the parts recognized as defective by our services and applies to the following parts:

- Metal frame against corrosion.

- Composite slate and metal frame against any deformation.

- Textile of the tabletop and bands against any detachment and any damage caused by miscues.

- The rot-proof nature of the textile of the tabletop and bands.

Not included in the warranty: the cost of shipping defective parts, cash or in-kind compensation for table immobilization during the warranty period.

Additionally, CORNILLEAU guarantees the availability of spare parts for products sold on the website www.cornilleau-services.com for a period of 20 years from the year the table was placed on the market, except for wooden parts for which no warranty is provided.

LIFESTYLE FOOSBALL TABLES

All our outdoor lifestyle foosball tables are guaranteed for 5 YEARS from the date of purchase by the end consumer. It applies to all parts present on the foosball table except for the playfield, which is guaranteed for 3 years against any deformation.

The warranty is limited to providing the parts recognized as defective by our services and does not apply to damage caused by:

  • - Normal and natural wear and tear of parts.
  • - Abnormal use of the product, other than intended (playing foosball).
  • - Improper assembly not following the instructions provided with each foosball table.
  • - Failure to follow the usage and safety instructions in the manual (twisting the rods, climbing on the foosball table, etc.).
  • - Lack of maintenance. See our advice page: 'How to maintain your foosball table'.
  • - Use of aggressive cleaning products.
  • - Various stains (food, animal, unsuitable household products, etc.).
  • - Generally, any cause unrelated to the quality of the foosball table (impacts, falls).

b) Modalities

When a product is found to be defective during the warranty period, the Client must contact CORNILLEAU Customer Service, which will provide them with the procedure for returning the product.

To process a claim, the Internet User must provide the following information:

- Type and reference of the product concerned

- Serial number of the product concerned

- Description or reference of the part concerned, if applicable

- Proof of purchase and date of purchase

- Precise description of the problem encountered, CORNILLEAU may also request photographs of the product subject to the claim.

No return will be accepted without prior agreement by Customer Service and the issuance of a return number materializing the effective agreement between the two parties.

The return shipping costs remain the responsibility of the Client.

After verification by CORNILLEAU of the condition of the product and if the warranty is applicable, the product will be repaired or replaced. If, however, the product is not repairable and cannot be exchanged for an identical or equivalent product, it will be refunded following the same procedures as those outlined above for the right of withdrawal.

Whether the warranty applies or not, the shipping costs for returning the repaired or replaced product to the Client remain the responsibility of the Client in all cases.

c) Warnings

Products whose deterioration results from negligence, mistreatment, or improper use compared to the instructions for installation and operation of the product will void any manufacturer's warranty. The product will be returned to the Internet User as is or repaired upon acceptance and prior payment of a quote established by CORNILLEAU.

For added security, it is strongly recommended to use the protective covers sold by CORNILLEAU.

9.2 – LEGAL WARRANTY OF CONFORMITY

The Company guarantees the conformity of the products to the contract, allowing the Client to make a request under the legal warranty of conformity provided for in articles L217-4 and following of the Consumer Code.

When the Client invokes the legal warranty of conformity, which applies independently of any commercial warranty granted, the Client:

- Has a period of 2 years from the delivery of the goods to act;

- May choose between repairing or replacing the goods, subject to the cost conditions provided for in article L217-9 of the Consumer Code;

- Is exempt from providing proof of the existence of the lack of conformity of the goods during the 24 months following the delivery of the goods, except for second-hand goods for which the period is 6 months.

Implementation of this warranty is free of charge for the Client.

ARTICLE 10 - NON-COMPLIANT RETURN

Any return designated as such in these general terms and conditions of sale is considered non-compliant.

For any non-compliant return, CORNILLEAU will return the product to the Internet User and will invoice them a flat rate covering the transportation costs of the product returned as non-compliant from CORNILLEAU to the Client.

The Internet User will be notified by email of the non-compliance of their return as well as the payment terms for transportation costs. These transportation costs will be payable by Bank Check or Postal Check only and must be sent to CORNILLEAU.

CORNILLEAU will only return the product returned as non-compliant to the Client once the transportation costs and the cost of processing the non-compliant return have been paid.

ARTICLE 11 - RESPONSIBILITIES

The responsibility of CORNILLEAU cannot be held liable in the event of a breach of any contractual obligations due to a fortuitous event or a force majeure event as defined by French jurisprudence.

In no event shall the liability of CORNILLEAU be incurred for loss of profits, loss of business, loss of data, or any other indirect or unforeseeable damage at the time of use of the website or the conclusion of the sales contract between the Parties.

The responsibility of CORNILLEAU shall not be incurred for any damages inherent to the use of the internet network (interruption, virus).

ARTICLE 12 - SITE ACCESS LICENSE

CORNILLEAU grants a limited license to access and use the site for the personal use of the Internet user. Under no circumstances does this confer the right for the Internet user to download or modify all or part of the site without the express written permission of CORNILLEAU.

This license does not allow any other use, especially commercial, of the site or its content (products, descriptions, prices, data, software, sound clips, graphics, images, photographs).

All elements of this site, whether sound or visual, including the technology used, remain the property of CORNILLEAU and are protected by copyright, trademarks, or patents.

Furthermore, any simple or hypertext link is strictly prohibited without the written and express consent of CORNILLEAU.

ARTICLE 13 - PROTECTION OF PERSONAL DATA

ARTICLE 14 - COOKIES

CORNILLEAU implants cookies on your computer. These cookies do not allow CORNILLEAU to identify the Internet user. They generally record information about the Internet user's browsing on the site (pages viewed, date and time of consultation...) that CORNILLEAU can read during subsequent visits by the Internet user. The cookies will therefore contain information provided by the Internet user.

CORNILLEAU informs the Internet user that they can oppose the recording of 'cookies' by accessing the configuration menu of their browser in order to set it up."

ARTICLE 15 - ELECTION OF DOMICILE

The election of domicile is made by the Company, at its registered office currently located at La Folie - 14 route Nationale - 60120 Bonneuil les Eaux.

ARTICLE 16 - APPLICABLE LAW - DISPUTE - MEDIATION

This contract is subject to French law.

In the event of a dispute or complaint, it is recommended that the Client contacts the Company's customer service to seek and find an amicable solution.

In accordance with the provisions of the Consumer Code concerning amicable dispute resolution, CORNILLEAU SAS adheres to the Mediator Service of e-commerce of the FEVAD (Federation of e-commerce and distance selling) whose contact details are as follows: 60 Rue La Boétie - 75008 Paris - http://www.mediateurfevad.fr. After prior written approach by consumers to CORNILLEAU SAS, the Mediator Service can be contacted for any consumer dispute that has not been resolved.
